2. Eligibility

By using our Services, you confirm that you are:

  • Legally capable of entering into binding agreements.

If you are accessing Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

4. Subscription, Payments & Billing

5. Refund & Cancellation Policy

  • Subscription fees for SaaS products, hosting, CRM, or digital services are generally non-refundable, unless explicitly stated otherwise.

  • Web design or custom development fees are non-refundable once work has commenced.

  • Refunds, if any, will be provided solely at the discretion of Blueferns Technologies.

6. Intellectual Property Rights

All content, source code, software, logos, designs, graphics, documentation, and other materials provided by Blueferns Technologies remain the intellectual property of the Company, unless explicitly transferred in writing.

Clients receive a limited, non-exclusive, non-transferable license to use the Services for their internal business purposes.

You may not:

  • Copy, modify, reverse engineer, or redistribute our software

  • Use our content without permission

  • Claim ownership of any part of our intellectual property

7. Client Responsibilities

You agree NOT to use the Services for:

  • Illegal, harmful, or fraudulent activities

  • Sending spam, phishing, or malware

  • Hosting prohibited or copyrighted content

  • Violating third-party rights

Clients are responsible for maintaining backups of their own data unless they subscribe to a backup service.

8. Data Protection & Privacy

We collect and process data in accordance with our Privacy Policy (I can generate one if needed).

We use reasonable administrative, technical, and physical measures to protect your data, but we cannot guarantee absolute security.

9. Service Availability

While we strive to maintain high uptime and reliability, we do not guarantee:

  • Complete absence of errors or delays

Planned maintenance may result in temporary downtime.

10. Third-Party Services

Some Services may rely on third-party providers (hosting, payment gateways, APIs, SMTP, etc.).
Blueferns Technologies is not liable for failures or downtime caused by third-party systems.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Blueferns Technologies is not liable for any indirect, incidental, consequential, or punitive damages.

  • Our total liability will not exceed the amount paid by you for the Service in the last 3 months.

You use our Services at your own risk.

  • Payments are overdue

  • Illegal or abusive usage is detected

You may terminate your account by contacting us. However, fees already paid are non-refundable.
